Questo contributo presenta alcune note sulla teoria suareziana della “guerra giusta”, argomento a proposito del quale il maestro spagnolo continua ad essere molto studiato, anche in chiave comparativa. Lo studio e l’approfondimento di questo teologo, giurista e metafisico gesuita si mostra di grande attualità perché può offrire degli utili spunti per cercare di rispondere alla domanda se può esistere una “guerra giusta”, e se può o deve darsi una “guerra umanitaria”. Suárez si interrogò infatti sul tema della liceità e doverosità o meno dell’intervento bellico preventivo per soccorrere gli innocenti, nonché sulla questione della possibilità di una eventuale guerra che sia “giusta” per entrambe le parti in conflitto. Si presentano per questo i principali elementi della disputatio De bello, dopo aver contestualizzato il problema del diritto di guerra, e l’insieme della produzione del teologo spagnolo di cui nel 2017 ricorreva il quarto centenario dalla morte.

This contribution presents some notes on Suárez’s theory of “just war”, a topic about which the Spanish master continues to be well studied, even in comparative terms. The study and deepening of this Jesuit theologian, jurist and metaphysician is very timely because it can provide useful insights to answer the question of whether there can be a “just war”, and whether there can or ought to be a “humanitarian war”. Suárez questioned the legality and appropriateness of a preventive war intervention in order to assist the innocents; he also discussed the possibility of any war being “right” for both sides in the conflict. This is why, after having contextualized the problem of the right to war and the production of the Spanish theologian, the main elements of his disputatio De bello are presented in his fourth death centenary.
